Discrimination is a condition when one acts against prejudice and stereotypes.
Direct Discrimination:
Direct discrimination is when somebody is treated unequally because of shared attributes. George floyd got killed because he is discriminated against racism. Even after long fighting struggle of independance, discrimination still exists.
India after Independance made untouchability a punishable crime.
Also we have Article 15, under which state shall not discriminate any person only on the grounds of race, religion, caste, sex..which protects against discrimination
Here the directive used on article points out that still there can be discrimination against other attributes.
Indirect Discrimination:
When the criteria is appear to be neutral, but actually there is discrimination
Eg :2018 Delhi high court Madhu vs Northern Railways
Free Medical services has been denied for wife and children, once the husband struck down the names of them. Only under divorce scenario, it can be done. So supreme court upheld the case by adding them back and and gave separate card for wife and children.
This example comes under indirect discrimination. Only strong constitutional legislation can enforce the right and protect against all sorts of discrimination. Our Government should work towards the same.

Direct and Indirect forms of discrimination militate against constitutional rights of equality. elaborate.
An employer fires a female employee after her marriage because he makes the assumption that married women do not make efficient workers. This is an example of direct discrimination in relation to sex.
An employer pays part-time workers at a lower hourly rate than full-time workers for doing the same work. A majority of part-time workers in his establishment are women but a majority of full-time workers are men. This is an example of indirect discrimination in relation to sex.
Under Article 15 it says, discrimination against any citizen on ground of Religion, caste, race, sex and place of birth is an offense.
We can observe that even today, discrimination at all levels is still prevailing even after the right amount of education, social well being and the thinking capacity of people have evolved.
Race, being the most affected internationally, what we as Indians face is based on religion and caste.
The constitutional rights of equality for Indians are treated badly because there is no strong law to support the rights. The current scenario in the United States is based on these but in India, no matter the discrimination is direct or Indirect, it has been never this bad.
Not ignoring the movements that have been happening to have the change in how people have been discriminated, the Equality bill 2019 and Mr. Shashi Tharoor putting forth the private member’s bill (drafted by Tarunabh Khaitan) are some attempts to have a chance to relook into our legislation than before. To summerise, the idea of creating an anti-discrimination law that will help for the betterment of life, a law that will help reverse our deep-rooted culture of discrimination, is worth thinking about.

A:) When we talk about diversity of India then discrimination on the name of cast,religion and sex also a topic of hotly debate even in 21st century. Where cast and religion based discrimination are direct then policy based discriminations like less salary of women are covered under indirect.
Despite having rule and regulations, social movements and increasing literacy, discrimination prevalent everywhere in the world is rising day by day. Jorge floid is just one result of it. So cases of castist rapes, Honor killings and evocative lynchings are not totally traditional. They gets fuel from many sources. Currently cast,color and ideology based politics of parties is one source of it. That's why Right to equality which is given in article 14 to 18 become Mute spectator or helpless sometimes.
Not only India but also democratic countries of the world need to take hard actions and implement them. Because for india " We the people of India" not just a line of holy book, it's our destiny which our forefathers gave to us.
Hence, for making New India of our dreams we need to ensure social, political and economic equality of our citizens. Because helplessness of poor's in a rich country also a act of discrimination .

Article 15 clause 2 states that no citizen shall be discriminated on the grounds of religion,race,caste,sex or place
So under the constitution discrimination of any form be it direct or indirect is against the vision of equality. But many discriminations are still prevalent in our society such as selection of house on the basis of religious faith as mentioned by cricketer Irfan Pathan, also in 2005 the supreme court Zoroastrian cooperative housing society versus discrimination district registar co operative societies enclosed one such restrictive bond when it ruled in the favor of Parsis prohibiting the sales of property to non Parsis hence this ruling overlooked article 15 altogether
Hence now more than ever the idea of enacting a law on the basis of anti discrimination will help reverse our deep rooted culture of discrimination

Article 15(2) Stipulates that citizens should not be discriminated merely on the grounds of race, religion, caste, sex and place of birth yet the evil of discrimination still prevails in many forms both directly and indirectly.

Direct Forms of Discrimination
– Historically people have been discriminated on the grounds of caste, creed, religion and sex.
– Incidents like Georgy flyod, revelations made by West Indies Cricketer and others exposes the fact that racial discrimination is even practiced as a mere weapon of suppression by the dominating authority.
Indirect Discrimination
– At times discrimination is indirect and unintended yet exists in various forms in the society. In an act of tending to support a person in a group, others are left out to suffer; and such biased approach results in indiscrimination.
– Examples of such discrimination can be found in work places occupied by different genders.
– Though numerous laws are put into force by the authorities, the execution of such laws have considerable resistance from being accepted by communities. Once such instance can be seen through the results/rankings of some countries and their inablility to improve in indices like Global gender gap report 2019-20, Human development index etc
– However the right against discrimination which applies horizontally comes into conflict with rights of persons to associate with others, often to the exclusion of certain groups. Ex: SC -2005 verdict on Zoroastrian cooperative housing society vs District registrar cooperative societies.
Way forward: Referring to an Aesop fable of “offering milk to Fox and stork”, a government should understand the fact that, by Merely providing the schemes, regulating the laws, forming organizations – Practices that are fair in form but discriminatory in operation will not yield the desired results.
Hence an anti-discriminatory law in India by understanding that discrimination takes places in different forms- should frames a law with a wider approach amongst our constitutional commitments.
